Terms of Service

The following terms and conditions govern your use of CrossPost ("CrossPost", "we", "us", "our", or "the Service"), a web application available at https://www.getcrosspost.com that lets you upload a video once and publish it to all of your connected social media accounts at once. By accessing or using CrossPost, you ("User", "you", "your") expressly agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

We reserve the right to update these Terms at any time. Material changes will be communicated via the Service or by email. Your continued use after changes are posted constitutes acceptance of the revised Terms.

1. The Service

CrossPost enables content creators to connect their own social media accounts (such as TikTok and YouTube), upload a video, and publish it to all of their connected accounts at once, each in that platform's native short-form video format. CrossPost is a publicly available service open to any creator who signs up at https://www.getcrosspost.com.

From time to time, we may change, modify, or upgrade the functionality or appearance of CrossPost, including adding or removing features or platform integrations. CrossPost may be temporarily unavailable for maintenance or upgrades. We do not guarantee continuous availability or that any particular video will be successfully published to any connected platform.

By connecting your social media accounts to CrossPost, you agree to be bound by those platforms' own terms of service, including TikTok's Terms of Service and YouTube's Terms of Service.

2. Eligibility

You must be at least 18 years old to use CrossPost. By using the Service, you confirm you meet this requirement and have the legal capacity to enter a binding agreement.

3. Licence

Subject to these Terms, CrossPost grants you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. This licence is personal to you and may not be shared, assigned, sublicensed, or transferred to any other person or entity without our prior written consent.

You connect your social media accounts via each platform's official OAuth 2.0 authorisation flow. We never have access to your social media passwords. You are responsible for:

CrossPost and all of its content, features, and functionality — including but not limited to software, design, text, and graphics — are owned by CrossPost and protected by copyright, trademark, and other intellectual property laws. You agree to abide by all copyright notices and trademark restrictions. You may not copy, extract, reverse engineer, decompile, disassemble, or create derivative works of CrossPost.

6. Your content and intellectual property

You retain full ownership of all videos and content that CrossPost publishes on your behalf. You grant CrossPost a limited, non-exclusive, worldwide, revocable licence to access, transmit, and post your content solely to provide the Service.

CrossPost does not modify, edit, claim ownership of, monetise, or permanently store your video content. Your uploaded videos are stored only transiently while being published to your connected platforms and are deleted promptly once posting completes.

CrossPost will not use your content for AI training or any commercial purpose beyond operating the Service.

You confirm that you own or have all necessary rights, licences, consents, and permissions for every piece of content that CrossPost publishes on your behalf, and that such content does not infringe any third-party intellectual property rights.

You may use CrossPost only to publish content to social media accounts you own or are authorised to operate, and only content you own or have the rights to distribute. You may not use CrossPost to:

CrossPost integrates with TikTok, YouTube, and other social media platforms, which are independent third parties with their own terms of service, community guidelines, and API policies. You are solely responsible for complying with those platforms' rules. We are not liable for:

CrossPost is provided "as is" and "as available" without warranty of any kind, express or implied. To the maximum extent permitted by applicable law, we disclaim all warranties including fitness for a particular purpose, merchantability, and non-infringement.

To the maximum extent permitted by applicable law, CrossPost shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits, loss of data, business interruption, or failure to publish content to any social media platform, even if we have been advised of the possibility of such damages.

CrossPost's total cumulative liability to you for any claim arising from or related to the Service shall not exceed the total fees paid by you to CrossPost in the twelve (12) months preceding the event giving rise to the claim, or £10, whichever is greater.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

10. Indemnification

You agree to indemnify and hold CrossPost and its operators harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your breach of these Terms; (c) your infringement of any third-party intellectual property or other rights; or (d) any content you cause CrossPost to post on your behalf.

11. Force majeure

CrossPost shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, government action, power failures, internet or telecommunications outages, or disruptions to third-party social media platforms or APIs. If a force majeure event affecting core services continues for more than 60 consecutive days, you may terminate your account.

12. Termination

You may disconnect your social media accounts and stop using CrossPost at any time from your dashboard. Upon disconnection, the associated access tokens will be deleted within 30 days.

We may suspend or terminate your access at any time if you breach these Terms. Sections 5, 6, 9, 10, 13, and 14 survive termination.

13. Dispute resolution

Before initiating any formal proceedings, you agree to attempt to resolve any dispute informally by contacting us at hello@getcrosspost.com. We will attempt to respond within 30 days. If the dispute is not resolved within 60 days of initial notice, either party may proceed to the courts as set out in Section 14.

14. Governing law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection laws in your jurisdiction provide otherwise.

15. Privacy and data protection

CrossPost collects and processes personal data in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using CrossPost, you consent to the collection, use, and processing of your personal data as described in the Privacy Policy.

16. Severability

If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

17. No waiver

Failure by either party to exercise any right under these Terms shall not constitute a waiver of that right. No waiver of any breach shall constitute a waiver of any subsequent breach.

18. No joint venture

Nothing in these Terms creates a partnership, joint venture, agency, franchise, or employment relationship between you and CrossPost. You have no authority to obligate or bind CrossPost in any manner.

19. Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and CrossPost with respect to the Service and supersede all prior agreements and understandings, whether written or oral.
